In order to reopen the question without pre- judice to what has gone before, and to elicit on what terms general -ly stone could be obtained, in as much as the charge of creating

a monopoly has been denied, I addressed to the Commissioner of

Foreign Affairs two Lemoranda, copies of which, and of the reply

thereto are enclosed. The eventual answer I anticipate is that it

is no part of the Commissioner's duty to assist foreigners in

finding sellers, as the latter can be found in the open market. No

Chinese contractor, however, is at the present moment disposed to

enter into negotiations, in view of Ir. Kuan's appeal to one of

their number not to assist foreigners, and through fear of pecuniary

fine or other punishment, should he attempt to do so.

The deadlock is an absolute one and the

defiance of Treaty incontestable. I greatly regret that I am not in a position to make any useful suggestions as to how either can be

overcome.
